These Terms & Conditions ("Terms") govern your use of wearejsmediaco.com and the online services provided by JS Media ("JS Media," "we," "us," or "our"). By accessing or using the website, you agree to these Terms. If you do not agree, do not use the website.
These Terms apply to the website and online inquiry process. They are not a substitute for a signed photography, videography, content-production, licensing, or other client service agreement. If a separate written agreement between you and JS Media conflicts with these Terms regarding booked services, the separate written agreement controls for those services.
Website purpose
The website describes JS Media's photography, videography, event coverage, corporate and founder imagery, podcast-style reels, social content, real estate media, and related services. It also allows prospective clients to view selected work and submit information so JS Media can evaluate a potential engagement.
Eligibility and authority
You may browse the website subject to these Terms. If you submit a business inquiry, request a quote, or seek to book services, you represent that you are at least 18 years old and have legal capacity to do so. If you act for a company, nonprofit, agency, venue, property owner, or other organization, you represent that you are authorized to submit the inquiry and communicate with JS Media on its behalf.
Website information
We work to keep website information accurate and current, but examples, availability, service descriptions, turnaround references, locations served, portfolio items, introductory offers, and other content may change. Website content is provided for general information and does not constitute a binding quote, guarantee, representation of availability, or promise that a particular service, creative approach, deliverable, date, or price will be offered to every prospective client.
Questionnaire and inquiries
Submitting the JS Media questionnaire or contacting us is a request for information only. It does not create a booking, reservation, client relationship, production commitment, or binding service contract.
JS Media may review the information you submit and respond with availability, recommendations, questions, pricing, a proposal, or next steps. We may decline an inquiry, recommend a different scope, or determine that we are unavailable without creating liability merely because a questionnaire was submitted.
You are responsible for providing complete and accurate contact, timing, venue, service, budget, and usage information so we can evaluate the request appropriately.
Introductory offers, pricing, and estimates
Any "introductory offer," sample price, starting point, estimate, or other promotional language shown on the website is subject to availability and the details of the requested work. Unless JS Media expressly states otherwise in a written proposal or agreement, website pricing and offers are not binding quotes.
Final scope and pricing may depend on factors such as date, location, travel, timing, coverage length, crew needs, equipment, number or type of deliverables, editing, revisions, licensing, usage, turnaround, access requirements, venue conditions, and other production considerations.
Bookings, payment, cancellations, and service agreements
A service is booked only when the booking requirements stated by JS Media have been completed. Those requirements may include a signed proposal or service agreement, deposit or other payment, confirmation of date and scope, and any other conditions stated in writing.
Payment schedules, deposits, retainers, cancellation or rescheduling terms, travel fees, overtime, delivery schedules, revision limits, usage rights, releases, weather contingencies, and other service-specific obligations will be stated in the applicable written proposal or service agreement. If no booking agreement has been accepted, the website itself does not create those obligations.
Information and materials you submit
You agree that information you submit through the website is accurate to the best of your knowledge and does not violate the rights of another person or organization.
If you voluntarily send reference images, logos, brand materials, scripts, documents, links, creative briefs, or other materials to JS Media in connection with an inquiry, you represent that you have the right to provide them for evaluation. You grant JS Media a limited, non-exclusive permission to access, review, reproduce internally, and use those materials only as reasonably necessary to respond to the inquiry, prepare a proposal, or administer a potential engagement, unless a separate agreement provides otherwise.
Do not submit confidential information that JS Media has not agreed in writing to receive confidentially. Submission of an inquiry by itself does not create a fiduciary, confidential, employment, partnership, agency, or joint-venture relationship.
Website intellectual property
The website and its original text, design, layout, graphics, branding, logos, photographs, video, reels, edits, compilations, and other content are owned by JS Media or used with permission and are protected by copyright, trademark, and other intellectual-property laws.

Portfolio work and third-party marks
The website may display work created for clients, events, community organizations, businesses, venues, or other third parties. Third-party names, logos, trademarks, signage, and brands remain the property of their respective owners. Their appearance in portfolio imagery does not, by itself, mean that the third party sponsors or endorses JS Media.
Acceptable use

- submit false, fraudulent, harassing, defamatory, unlawful, or malicious material;
- attempt to gain unauthorized access to the website, server, forms, email systems, accounts, or data;

Governing law and venue

A separate signed client agreement may contain different dispute-resolution, venue, mediation, or other provisions for booked services, and those provisions will control for that client engagement.
General terms
Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
No waiver. A failure by JS Media to enforce a provision does not waive the right to enforce it later.
Assignment. You may not assign your rights or obligations under these website Terms without JS Media's written consent. JS Media may assign these Terms in connection with a merger, sale, reorganization, or transfer of its business or assets, subject to applicable law.
Headings. Headings are for convenience and do not limit the meaning of the provisions.
Changes to these terms
We may update these Terms from time to time to reflect changes in the website, services, business practices, or law. The "Last updated" date at the top will show the latest revision.
